Hobby Lobby Stores has appealed a federal judge?s decision denying the craft supply chain?s request to not provide employees with insurance that covers morning-after and week-after birth control pills, as mandated by the ObamaCare law.
The Christian-owned company asked for relief in the face of fines they say could reach $1 million a day for not providing the coverage.

Churches and other religious organizations have been granted constitutional protection from the birth-control provisions, but Hobby Lobby and Mardel ?are not religious organizations.?

The appeal was filed Tuesday in the 10th Circuit Court of Appeals after a federal judge in Oklahoma on Monday denied the owners? request for a temporary injunction against the provisions of the Obama administration?s health law.
The chain?s appeal states in part that Chief Executive Officer David Green his family in less than six weeks ?must either violate their faith by covering abortion-causing drugs or be exposed to severe penalties ? including fines of up to $1.3 million per day, annual penalties of about $26 million and exposure to private suits.?

The Oklahoma City-based company and a sister company, Mardel, sued the government in September, claiming the mandate violates the owners? religious beliefs. The owners contend the morning-after and week-after birth control pills are tantamount to abortion because they can prevent a fertilized egg from implanting in a woman?s womb. They also object to providing coverage for certain kinds of intrauterine devices.

The decision was made by U.S. District Judge Joe Heaton, in a 28-page ruling.
At a hearing earlier this month, a government lawyer said the drugs do not cause abortions and that the U.S. has a compelling interest in mandating insurance coverage for them.

In his ruling, Heaton said churches and other religious organizations have been granted constitutional protection from the birth-control provisions, but Hobby Lobby and Mardel ?are not religious organizations.?

?Plaintiffs have not cited, and the court has not found, any case concluding that secular, for-profit corporations such as Hobby Lobby and Mardel have a constitutional right to the free exercise of religion,? the ruling also stated.
Kyle Duncan, general counsel for the Becket Fund for Religious Liberty, said before the appeal: ?Every American, including family business owners like the Greens, should be free to live and do business according to their religious beliefs.?
Hobby Lobby is the largest business to file a lawsuit against the mandate.

The company calls itself a ?biblically founded business? and is closed on Sundays. Founded in 1972, the company now operates more than 500 stores in 41 states and employs more than 13,000 full-time employees who are eligible for health insurance coverage. The company, which is self-insured, has said it will face a daily $1.3 million fine beginning Jan. 1 if it ignores the law.

How climate change could affect entire forest ecosystems

ScienceDaily (Nov. 28, 2012) ? The fog comes in, and a drop of water forms on a pine needle, rolls down the needle, and falls to the forest floor. The process is repeated over and over, on each pine needle of every tree in a forest of Bishop pines on Santa Cruz Island, off the coast of Santa Barbara. That fog drip helps the entire forest ecosystem stay alive.

Thousands of years ago, in cooler and wetter times, Bishop pine trees are thought to have proliferated along the West Coast of the U.S. and Mexico. Now, stratus clouds -- the low-altitude clouds known locally as "June gloom" -- help keep the trees growing on Santa Cruz Island, Santa Rosa Island, and on one island off Baja California. Other than these locations, Bishop pine trees grow only farther north in California where it is cooler and wetter.

Mariah S. Carbone, first author of a new paper, titled "Cloud Shading and Fog Drip Influence the Metabolism of a Coastal Pine Ecosystem," and her co-authors, studied the influence of clouds on the largest Bishop pine forest of Santa Cruz Island. Carbone is a postdoctoral fellow with UC Santa Barbara's National Center for Ecological Analysis and Synthesis (NCEAS). Their study was published in the journal Global Change Biology.

"When people think about climate change, they're often thinking about temperature and precipitation," said Carbone. "When you think about precipitation, it's rain and snow, depending on where you are. What this study showed is that you can have really important water inputs coming from clouds that influence the carbon cycle."

She explained that clouds are one of the largest uncertainties in global climate, and that the forest ecosystem interactions with clouds have a large impact -- one that has rarely been studied before, particularly in Southern California.

Changes in cloudiness or cloud height with global warming will alter the types of forest ecosystems that grow in coastal California, explained Carbone. While predictions about how rainfall will change in California over the next 50 years are uncertain, fog and low-stratus clouds might decline as sea-surface temperatures warm. Like the relict Bishop pines on Santa Cruz Island, and the majestic coastal Redwood forests in Northern California, forests remove and store carbon from the atmosphere, and thus are important for understanding greenhouse gas concentrations in the future. These coastal forests are also highly valued for their aesthetic and recreation qualities.

Fog is often present in coastal California during May through August. It occurs when the land warms in the spring and summer, and moist ocean air is pulled over cold, upwelling coastal waters. This moist air then condenses under a stable atmospheric inversion layer, creating low clouds or fog banks.

"The finding that summer fog strongly impacts carbon cycling highlights the need for improved understanding of whether we should expect coastal summer cloud behavior to change in a warmer world," said second author A. Park Williams, a former graduate student in UCSB's Geography Department, now at Los Alamos National Laboratory. "A change in summer fogginess could produce temperature, moisture, and carbon feedbacks in coastal ecosystems that easily swamp out the effects expected from increased greenhouse gases alone," said Williams.

The carbon cycle involves the movement of billions of tons of carbon between the oceans, lands, and atmosphere every year. Increased amounts of carbon dioxide, a potent greenhouse gas, ??are injected into the atmosphere and contribute to climate change.

The scientists received help from NASA and NOAA in collecting information. "We used satellite data to map the spatial distribution of cloud cover across the western portion of Santa Cruz Island," said senior author Christopher J. Still, formerly an associate professor at UC Santa Barbara, now at Oregon State University. "We had some evidence of a cloud cover gradient from the coast to inland, based on our own observations and our weather station data, but the satellite data -- from NOAA and NASA satellites -- really allowed us to quantify this gradient across the western half of the island and in particular at our two study sites," said Still.

Still said that the authors believe this study is unique in linking clouds to soil microbial activity. "While most previous research on fog and ecosystems has focused on its role in plant-water relations -- such as the well-known linkages between fog and coast Redwoods -- we show that soil microbial activity and metabolism in these coastal ecosystems may be very dependent on the light but frequent fog drip that occurs during the rainless summer months," said Still. The study is also unique in linking fog and low clouds to the carbon cycle of a coastal ecosystem, including its impact on tree growth and soil respiration.

"What we found was that there are two major effects of the clouds," said Carbone. "One is shading, which keeps the temperatures cooler and the soil moisture higher. The other is fog drip, which is a water input into the soil."

The soil moisture content was not depleted as rapidly where the trees were under more cloud cover, and thus they were able to grow longer into the dry season. Water pulses from fog drip immediately stimulated microbes in the litter and soil below, but did not directly enhance pine tree activity. The microbial activity releases carbon dioxide into the atmosphere.

"This study provides us with a greater understanding of how fog and the low coastal clouds which Californians commonly call 'the marine layer' affect plant growth and the activities of microorganisms in the soil," said John Randall, scientist with The Nature Conservancy, which owns and operates Santa Cruz Island in cooperation with the National Park Service and the University of California. "Their findings of the importance of fog and low clouds in influencing plant growth and survival and microbial metabolism in the soil will help us understand how changes in coastal fogs and low clouds that may accompany climate change will affect the forests and soils on Santa Cruz Island, other islands off the coast of California and Mexico, and all along the coast of the adjacent mainland."

The work on Santa Cruz Island, conducted in cooperation with The Nature Conservancy, was funded by grants from the Andrew Mellon Foundation and the Kearney Foundation of Soil Science. The NOAA Climate and Global Change Postdoctoral Fellowship and the National Center for Ecological Analysis and Synthesis have supported Carbone.

Community colleges are great because they offer students practical experience.

One can also do some extra work on their own to increase their skills and education. It is a great idea to find an experienced individual who works in the field and get close to them. An experienced worker can offer electrician training in the form of an apprenticeship or might be able to hire a student to work for them. They can also share the pros and cons of the industry, as well as stories from on the job. This will give the young student a better idea of what daily life is like as an electrical worker, and help them decide if this is really the field that they want to devote their life to. Working with a professional can help one meet others in the field and perhaps potential future customers. The pro may also have some suggestions for training programs or courses that the aspiring electrician can take advantage of. They can serve as a reference for the student's resume.

Before one can be successful in industry, they must have to proper education and training. Fortunately, budding electrical workers have many options to help them reach their goals and better themselves.

Bank of England warns UK banks may lack enough capital

LONDON (Reuters) - British banks may not have enough capital set aside as a defense against future financial market dangers due to their over-optimistic assessment of the risks facing them, the Bank of England said on Thursday.

The BoE's Financial Policy Committee, which from next year will take charge of British bank regulation, urged the current regulator to reassess whether banks' capital properly reflects the risk of loans going sour and future fines for misconduct.

Banks' true capital position was probably worse than relatively healthy official numbers imply, and that this is hurting investor confidence, the BoE said.

"Progress by banks in raising capital has slowed and investor confidence remains low," the BoE said in its half-yearly Financial Stability Report. "Market concerns are likely to reflect in part uncertainty about bank capital adequacy."

The FPC has repeatedly urged British banks to raise capital levels, and November's report marks a stepping up of these recommendations, despite a slight reduction in the risks facing the financial system due to an easing in euro zone tensions.

"UK banks' capital buffers, available to cushion losses and maintain the supply of credit following realization of a stress scenario, are not as great as headline regulatory capital ratios imply," it said.

Information from supervisors suggested some British banks would suffer bigger losses on loans than they had made provision for, it said.

Banks had also persistently underestimated the scale of fines they would face for past misconduct.

"In 2012, the number of identified conduct issues has grown and it seems likely banks could face additional sizeable costs," it said, adding that external analysts had suggested further costs of 4-10 billion pounds for mis-sold payment protection insurance and the LIBOR rate-rigging scandal.

The system of risk weighting that banks use to judge how likely they were to face losses was also "complex and opaque" and probably undermined investor confidence, the BoE added.

The BoE is also concerned that banks continue to lend to British businesses and households at a time when it blames a lack of bank credit as part of the reason for the country's very sluggish growth.

Inadequate capital buffers are not an excuse for reining back on lending, the central bank said.

"The Financial Services Authority should ensure that firms either raise capital or take steps to restructure their business and balance sheets in ways that do not hinder lending to the real economy," it said.

Occupy the drive-thru: Fast-food workers in New York City staged a walkout on Thursday to demand better pay and the right to unionize?in another recent example of labor stretching muscles made moribund by disuse.

Organizers?of the Fast Food Forward movement said they expected hundreds of workers would walk out or not show up for work at dozens of McDonald?s, Burger King and other fast-food chains.?

Late Thursday, Fast Food Forward, one of the organizations behind the effort, released a statement saying about 200 people had participated in the strike.

At one early?morning demonstration, roughly 75 percent of shift workers were outside protesting, leaving managers to staff the registers and preparation equipment, said Jonathan Westin, organizing director with New York Communities for Change, one of the groups coordinating the walkouts.

?Workers are sick and tired of making poverty wages,? despite working for multibillion-dollar corporations, he said. ?I don?t think this is a short-term fight.?

Joshua Williams, 28, works at?a Wendy's restaurant in Brooklyn and?told Reuters he planned to participate in the walkout. He said?he still earned minimum wage, despite working 30 to 40 hours a week for more than a year.

In seeking a $15 hourly wage and the right to unionize, the movement joined a growing conversation about the financial challenges faced by the working poor.

?During the recession there was the assumption that people should just get a job, any job... I think you see the movement towards unionization as a demand-side response, in a sense,? said Ellen Galinsky, president of the Families and Work Institute. ?Employees are saying, ?No, we want better jobs.??

The Fast Food Forward action, which is supported by the Service Employees International Union along with civil rights and community groups, comes less than a week after a union-backed effort to draw attention to wages and working conditions at Wal-Mart led to protests at stores across the country on Black Friday.?

Organization United for Respect at Walmart called on the nation?s largest retailer to pay a minimum $13 hourly wage. Sales associates there currently make an average of $8.81 an hour, according to third-party research cited by workers? rights groups.

Earlier this week, the National Domestic Workers Alliance released a report that found nearly a quarter of nannies, housekeepers and caregivers earn less than the state minimum wage, and 70 percent make less than $13 an hour.

?We must create a more equitable economic environment for all low-wage workers,? the?report said. ?It is difficult to advocate for the rights of domestic workers in an economic and political environment in which the rights of low-wage workers more broadly are so badly frayed.?

Advocates for higher wages say the focus on minimum and low-wage workers is important because there are more people earning less today. The National Employment Law Project found that about 20 percent of?jobs lost during the recession were?low-paying positions, but nearly 60 percent of the jobs?added since then.

?In my mind, if we?re going to reduce inequality in the United States, it?s going to have to address the low wages and lack of benefits in the restaurants and retail sectors,? said Annette Bernhardt, policy co-director at NELP. ?There?s a profound larger question being posed, which is how the American labor market is going to look in the 21st century.?

According to the Bureau of Labor Statistics, around 60 percent of workers who earned minimum wage or less last year worked in ?service occupations,? primarily food preparation and serving.

At more than double the current national?minimum wage of $7.25, the $15 sought by Fast Food Forward might seem like a pie-in-the-sky goal, but others are pushing to increase New York state's?minimum wage to $8.50 next year. According to the National Women?s Law Center, if the minimum wage rose at the pace of inflation, it currently would be $10.60.

The National Restaurant Association opposes this and other legislation to raise minimum wages. The position statement on its website says, ?Wage mandates are an ineffective way to reduce poverty and cause restaurant operators to make very difficult decisions to eliminate jobs, cut staff hours or increase prices.?

Richard Adams, a McDonald's franchise adviser, told Reuters $15 an hour would be an "insane increase" that would add as much as $2 to the price of menu items.

"The majority of McDonald's restaurants are owned and operated by independent business men and women who offer pay and benefits competitive within the quick service restaurant industry," the company said in a statement.

David Neumark, a professor of economics at University of California, Irvine, said campaigns to increase wages for minimum and low-wage workers miss the mark.

?A lot of the fast-food workers aren?t in poor families ? they?re just kids,? he said. ?Targeting low-income families through what they?re trying to accomplish is a really scattershot way to do it. Why should an owner... have to pay more to the kids of middle-class families??

Galinsky said higher wages are important, but companies also need to explore other ways to improve the experience of low-wage workers, since the jobs they are filling make up an increasing percentage of labor market demand.

?Traditionally, people who work in jobs like fast food or retail? have been seen as expendable, particularly in a time of economic insecurity,? she said. The institute?s research found that access to training and advancement opportunities, flexible schedules and supportive managers help to improve productivity and reduce turnover at companies that employ low-wage workers.

?There are things that employers can do, most of which don?t cost money, that could benefit employees and that could benefit their own organization,? she said. ?It?s a mindset change.?

Shell sees big boost from buyout of Chesapeake's Permian acreage

NEW YORK (Reuters) - Royal Dutch Shell expects "years and years" of production from oil and natural gas acreage it recently bought from Chesapeake Energy Corp and plans to add more drilling rigs, the head of Shell's Americas operations said on Thursday.

Shell paid $1.94 billion last September for 618,000 acres in the Permian Basin, a vast source of oil and natural gas in the western part of Texas.

Shell and other global energy companies including Exxon Mobil Corp and Chevron Corp are buying more oil and gas assets in North America as they struggle to boost production in a sector where a vast amount of resources is located and tightly controlled by countries like Brazil and Russia.

Much of the Permian Basin land, which Chesapeake was desperate to sell to get needed cash, is considered prospective at best, and it only has seven drill rigs in operation currently producing 26,000 barrels of oil equivalent per day, low by industry standards.

Shell believes the land holds potential to produce much more, and expects the rig count to rise to 10 "over a period of time," Marvin Odum, president of the Dutch oil major's U.S. arm, Shell Oil Co, and director of Shell's Upstream Americas division, said in an interview with Reuters on Thursday.

"We made a very good acquisition here," Odum said. "This is a relatively small payment for a lot of resources that are reasonably well-proven, but yet to be developed, and a very nice suite of acreage that's more in the appraisal/exploration phase."

Shell had little comment about the deal when it was first announced and has been quiet about production plans.

The company was attracted to the land because it already is producing, meaning production has been proved viable, Odum said. At the same time, Shell was intrigued about exploration possibilities elsewhere on the acreage, he said.

Children with higher intelligence less likely to report chronic widespread pain in adulthood

ScienceDaily (Nov. 29, 2012) ? A UK-based study team has determined that there is a correlation between childhood intelligence and chronic widespread pain (CWP) in adulthood, according to a new study published in the December issue of PAIN?. About 10-15 percent of adults report CWP, a common musculoskeletal complaint that tends to occur more frequently among women and those from disadvantaged socioeconomic backgrounds. CWP is a core symptom of fibromyalgia and is one of the most common reasons for consulting a rheumatologist.

"One psychological factor that could potentially be a risk factor for CWP in adult life is lower cognitive ability in youth," says lead researcher Dr Catharine R. Gale, MRC Lifecourse Epidemiology Unit, University of Southampton, UK, and Centre for Cognitive Ageing and Cognitive Epidemiology, Department of Psychology, University of Edinburgh, Edinburgh, UK. "Our hypotheses were that men and women who scored lower on the test of intelligence in childhood would have an increased risk of CWP in midlife and that some of this association would be mediated through socioeconomic status, mental health, or lifestyle factors in adulthood."

The investigators used data from the National Child Development Survey, an ongoing cohort study originally based on over 17,000 live births in Great Britain during one week in 1958. When cohort members were aged 11 years, they completed a test of intelligence. At the age of 45 years, 6902 cohort members took part in a biomedical survey during which they completed a questionnaire to assess the presence of chronic widespread pain (CWP).

CWP was found among 14.4 percent of the participants. Men and women with CWP scored significantly lower on the test of intelligence at age 11. They were also more likely to have manual jobs, to be a current or ex-smoker, to have a higher body mass index, and to report higher levels of psychological distress.

The study concluded that men and women with lower intelligence at age 11 are more likely to report CWP.

Says Gale, "To our knowledge, this is the first study to investigate the prospective relation between intelligence and CWP. Our results show that individuals with higher intelligence in childhood are less likely as adults to develop this common and disabling condition. We now need to understand the mechanisms causing this association."

In a commentary accompanying the article, Eva M. Kingma and Judith G.M. Rosmalen of the Interdisciplinary Center Psychopathology and Emotion Regulation, University of Groningen, University Medical Center Groningen, The Netherlands say: "Although an association between chronic pain and cognitive ability has been shown before, the Gale et al. report is the first longitudinal study in a large general population cohort.

Two important characteristics stand out in their study. First, its longitudinal design enabled the researchers to study causal direction as well as interesting explanatory mechanisms in the association between intelligence and pain. Second, the study used a population-based design, which contrasts with many previous etiological studies that compared patients to healthy controls. This approach is especially relevant because CWP is much more prevalent than clinical data on fibromyalgia suggest.

Patriot Coal bankruptcy moved to court in Missouri

NEW YORK (Reuters) - Patriot Coal on Tuesday lost a bid to keep its bankruptcy case in New York, after the United Mine Workers of America argued that the proceedings should be transferred to a venue closer to the company's operations.

U.S. Bankruptcy Judge Shelley Chapman in Manhattan moved the case to St. Louis, Missouri, where the company is based. As part of the bankruptcy, Patriot is expected to seek significant cuts in retiree pension and health benefits.

Patriot, the judge said in her ruling, incorporated two units in New York in the weeks leading up to its bankruptcy, essentially for the purpose of establishing venue there - a move that, while technically legal, was "simply not fair."

Patriot filed for bankruptcy in July, five years after being spun off by Peabody Energy and Arch Coal.

The union had wanted the case transferred to West Virginia, the hub of most of the company's operations but said it was satisfied with St. Louis.

"Nobody has ever mined one ounce of coal in Manhattan," the union said in a statement on Tuesday. "This decision brings the case to the heart of the Illinois coal basin, home to many of our active and retired members and their families."

Patriot had sought to keep the case in New York, a major site for corporate bankruptcies and the home of most of Patriot's lawyers and bankers. The company said it respected Chapman's decision.

"We remain focused on using the reorganization process to ensure the company's future viability as a competitor and employer in a challenging market environment," it said in a statement.

Chapman also criticized the union in her 62-page ruling, which she said aimed to define "the meaning of justice."

The union wanted to move the case to a West Virginia court where it felt judges would be more sympathetic to its cause, Chapman said.

"It is not in the interest of justice merely to swap one party's perceived home field advantage for another," the judge said, citing court hearings in which union lawyers expressed a desire for judges who "understand" and "worship" coal miners.

In court papers, Patriot has said its current labor obligations are "unsustainable" without cutting some benefits as it restructures.

The Mine Workers union has more than 10,000 retiree members whose pension and health obligations are administered by Patriot, though many never worked for Patriot and retired before the Peabody spin-off.

The union has vowed to protect its benefits through the bankruptcy, and has also sued Peabody Energy, saying it should cover benefits if Patriot cannot.

Chapman chose St. Louis, she said, because Patriot and many of its officers are based there. She added that she was influenced by hundreds of "compelling" letters from retirees, widows and families who wish to participate in the case.

"While St. Louis may not be as convenient as Charleston for some employees and retirees, it is by no means remote from coal country," the judge said.

The test balloon carried a humanoid robot up to an altitude of almost 20 miles (32 kilometers) on Nov. 12 ? just a few miles shy of where skydiver Felix Baumgartner leaped from during his "space dive" in October. Startup Zero 2 Infinity wants to eventually offer hours of flight time for space tourists to do whatever they want in a near-space environment.?

"Some people will want to tweet," said Jose Mariano Lopez-Urdiales, founder and CEO of Zero 2 Infinity. "Some will want to put down a carpet and pray to mecca. Some people will want to eat their favorite buffalo wings while they're up there."

The Spanish company already has customers on its wait list?who paid an early deposit of almost $13,000 (10,000 euros) as the first installment out of a total ticket price of $143,000 (110,000 euros). It has also attracted funding from the world's second-largest balloon manufacturer, Spain's third-largest bank, and several angel investors by proving its concept step-by-step and by relying on proven helium balloon technologies.?

Flight testing took place at an Air Force base near Virgen del Camino in Spain. But Lopez-Urdiales envisions future flights launching from many other locations in the country.?

The balloon experience?
A typical predawn flight would take several hours to reach maximum altitude, so that passengers could enjoy seeing the sun rise against the blackness of space and see the curvature of the planet Earth. Luckily, the balloon would not need to get anywhere near the 62-mile (100 km) altitude that marks the official edge of space for its riders to enjoy stellar views.?

"You would spend two hours at the floating altitude of 36 kilometers (22 miles)," Lopez-Urdiales told TechNewsDaily. "We could do it higher, but it would not make any difference, because you already see the same visual cues at 39 kilometers or even 100 kilometers."?

Getting back down would mean cutting the cord between the balloon and the enclosed passenger capsule. Passengers could experience about 40 to 60 seconds of weightlessness during free fall, before parachutes and a parafoil carried them safely down to Earth.?

The recent test flight gave Zero 2 Infinity its first successful test of a balloon capsule large enough to carry humans, but only if the two people spent the entire trip lying down. An earlier flight test scheduled in May was canceled after?wind gusts damaged the test balloon.?

Robot test pilots?
Future versions of the balloons, called "bloons" by the company, would have donut- or bagel-shaped capsules with plenty of standing room for two pilots and four passengers. But the test capsule proved just right for the humanoid robot named Nao ? made by Aldebaran Robotics ? that stands at knee-height compared to adult humans.?

The robot rode as a passive passenger, but could someday become an active pilot that tests the controls and life-support technologies meant for humans.?

"Little by little, we're teaching it how to pilot, but that's at a very early stage," Lopez-Urdiales explained. "The idea in the future is to have?humanoid robots?testing future complex aerospace vehicles."?

The company has almost finished building a bigger test balloon that could comfortably carry two people standing up. That larger balloon could make an attempt at breaking the manned high-altitude balloon record set in the 1960s ? a record that requires the pilot to take off and land in the balloon. (Space diver Baumgartner intentionally disqualified himself by leaping out of his high-flying balloon.)?

The inner journey?
But Zero 2 Infinity doesn't just want to make money. Lopez-Urdiales envisions his balloons carrying scientific experiments or scientists high into Earth's atmosphere. His inspiration for creating the startup company came from his dad, an astrophysicist who worked on an experiment that went with the Cassini-Huygens mission to Saturn's moon Titan.?

"I was growing up around balloons, rockets and telescopes," Lopez-Urdiales said. "My dad tested a Huygens scientific instrument on a high-altitude balloon."?

The balloon space tourism's relatively more affordable price tag could also open the eyes of many more people through the "overview effect," Lopez-Urdiales said. Frank White, a communications director at Harvard's Kennedy School of Government, coined the term to describe how astronauts gained a better appreciation of global and environmental issues after seeing the Earth surrounded by the darkness of space.?

"That's probably the biggest benefit?private spaceflight?will offer to civilians and members of the public," Lopez-Urdiales said. "The overview effect is personal experience, but then you share it. I think it goes a much longer way than bragging rights."?

President Barack Obama plans to make a public case this week for his strategy for dealing with the looming fiscal cliff, traveling to the Philadelphia suburbs Friday as he pressures Republicans to allow tax increases on the wealthy while extending tax cuts for families earning $250,000 or less.

The White House said Tuesday that the president intends to hold a series of events to build support for his approach to avoid across-the-board tax increases and steep spending cuts in defense and domestic programs. Obama will meet with small business owners at the White House on Tuesday and with middle-class families on Wednesday.

The president's visit to a small business in Hatfield, Pa., that makes parts for a construction toy company will cap a week of public outreach as the White House and congressional leaders negotiate a way to avoid the tax increases and spending cuts scheduled to take effect Jan. 1. The trip will mark Obama's first public event outside the nation's capital since winning re-election.

Both sides warn the so-called "fiscal cliff" could harm the nation's economic recovery, but an agreement still appears far from assured. The White House and congressional Republicans have differed on whether to raise revenue through higher tax rates or by closing tax loopholes and deductions.

House Speaker John Boehner, R-Ohio, has pushed for raising additional revenue through the reducing of tax loopholes instead of raising tax rates on wealthy Americans. The White House has countered that the president will not sign legislation that extends current tax rates for the top 2 percent of income earners, or those households with incomes over $250,000.

Pennsylvania Sen. Pat Toomey, a conservative Republican who opposes Obama's plan to increase taxes on the wealthy, said that while a presidential visit to his state "is always welcome," he remains staunchly against Obama's strategy for avoiding the fiscal cliff crunch.

"The president seems absolutely determined to inflict a tax increase on the American people," Toomey told CNN on Tuesday. He said Obama and congressional Democrats must come up with cuts in entitlement programs like Social Security and Medicare.

Obama, only weeks after winning re-election, has signaled his intention to rally the public to pressure Congress to support his agenda, an approach that helped him win passage of a payroll tax cut extension and prevented interest rates on millions of federal student loans from doubling last summer.

Obama campaign manager Jim Messina said in an email to supporters after the election that the president's volunteer base was crucial to his re-election but said it was not aimed "just to win a campaign. We have more progress to make, and there's only one way to do it: together."

Following the election, Obama aides asked supporters to record YouTube videos discussing the need to have the wealthiest Americans pay more in taxes. Some of the people who shared their stories on YouTube planned to join Obama at the White House on Wednesday.

On Friday, Obama will tour and deliver remarks at The Rodon Group manufacturing facility in Hatfield, Pa., offering the company up as an example of a business that depends on middle-class consumers during the holiday season. Republicans have called for changes to the tax code to eliminate tax breaks and loopholes that primarily benefit the wealthy. Several key Republican lawmakers have also said they would not be bound by a no-tax-increase pledge that they have adhered to in the past.

Best Buy's Canadian site just got a hardware surprise from Nintendo, the Wii mini. It looks like the retailer jumped the gun but unfortunately, it doesn't reveal much else aside from a December 7th release date. Rumors of a console refresh have circulated over the last few days and while the preorder link isn't live just yet, but you can spot the Wii mini's new red and black design, which looks to be only slightly taller than the original Wiimote. The Wii's successor launched only a few weeks earlier in the US, managing to sell 400,000 units in its first week. We've contacted Nintendo and we'll have more when we hear it.

Investor sues HP over Autonomy deal

SAN FRANCISCO -- Hewlett-Packard was sued on Monday by an investor who claimed the company knew statements about its Autonomy acquisition were misleading and led the stock to fall, according to lawyers representing the plaintiff.

The proposed class action lawsuit was filed in a San Francisco federal court.

HP dropped a bombshell last Tuesday with an $8.8 billion write-down on its acquisition of British software firm Autonomy, saying the company inflated sales with improper accounting. Autonomy co-founder Mike Lynch has denied any wrongdoing.

HP bought Autonomy for a hefty $11.1 billion last year. HP has said it alerted regulators on both sides of the Atlantic.

The lawsuit, one of the first to be filed by investors on the Autonomy mess, said HP hid the fact it gained control of Autonomy based on financial statements that could not be relied upon. It also said that HP had not revealed to investors that it tried to undo the Autonomy agreement before it closed because of the accounting issues.?

Israel's ex-FM Livni announces return to politics

JERUSALEM (AP) ? Former Israeli Foreign Minister Tzipi Livni announced her return to politics on Tuesday, telling supporters that she was forming a new party to run in January parliamentary elections on a platform promising an aggressive push for peace with the Palestinians.

Livni, who served as Israel's foreign minister and chief peace negotiator from 2006 to 2009, bitterly attacked Prime Minister Benjamin Netanyahu as she announced the formation of her new party, called "The Movement."

"I came to fight for peace ... and I won't allow anyone to turn peace into a bad word," she said.

Her announcement brought a new, high-profile voice to the campaign to oust Netanyahu's hardline government. But with his Likud Party leading in opinion polls and the dovish opposition divided between several parties, her candidacy did not immediately appear to pose a threat to the prime minister.

During Netanyahu's four years in power, peace talks with the Western-backed Palestinian government of President Mahmoud Abbas have remained frozen.

Frustrated with the impasse, Abbas is now heading to the United Nations this week to seek upgraded observer status for his people. Israel opposes the bid, saying Palestinian independence can only come through negotiations.

At the same time, Israel has now entered indirect, Egypt-mediated negotiations with Abbas' rival, the Islamic militant Hamas movement, as part of a cease-fire deal that ended an eight-day Israeli military offensive in Hamas' Gaza stronghold last week.

"Everything is upside down: a government that negotiates with terrorists and freezes all dialogue with those who work to prevent attacks, the opposite message that is needed in the tough neighborhood we live in," Livni said.

Livni was internationally respected during her term as foreign minister, forging a strong relationship with her American counterpart, Condoleezza Rice, as well as the Palestinians. She has been identified by both Time and Newsweek magazines as one of the world's most influential women.

But she has stumbled as a politician. Livni assumed leadership of the centrist Kadima Party in 2009 elections after then-Prime Minister Ehud Olmert was forced to resign because of a corruption scandal.

While Kadima won the most parliamentary seats in that election, Livni was unable to form a majority coalition and confined to the opposition. Kadima has steadily lost support, and early this year she was ousted as party leader. Recent polls have forecast that Kadima may not win even a single seat in parliament in the Jan. 22 vote.

Livni said she had not decided who would join her on her party list. One key question is whether Olmert, who was recently cleared of serious corruption charges, will join her.

She said she hoped Olmert would return to politics. But with Olmert still on the sidelines, she said she decided to enter the race "because the field remained empty." Olmert's office said only that he has not decided whether to enter the race or support Livni.

Livni, 54, joins a field that includes the centrist Labor Party, led by former journalist Shelly Yachimovich, and the centrist "Yesh Atid," led by former anchorman Yair Lapid. While largely similar in ideology, these rival parties have focused their agendas largely on domestic economic issues.

"I decided to give an answer to people who don't have anyone to vote for," Livni said. "This party will return this hope that was lost."

Livni's announced Tuesday was the latest move to shake the Israeli election campaign. On Monday, Defense Minister Ehud Barak announced his retirement from politics with his tiny Independence Faction struggling in the polls.

Also Monday, the Likud elected its slate of candidates for the new election. The list was dominated by hardline lawmakers opposed to peace efforts with the Palestinians, while Likud voters ousted a number of high-profile party moderates.

The combination of Barak's departure, and the hard-line character of Likud, could push some undecided voters back to the centrist opposition.

A new survey published Tuesday ? and based on a presumption that Livni would announce a new party ? predicted that her new party would garner nine seats in the 120-seat parliament, while Labor would win 20 and Lapid's party would get only five. That would leave the centrist bloc far short of the 61 seats needed to form a majority coalition.

In contrast, Netanyahu's Likud would win 37 seats, making it by the largest single party in parliament, with hardline nationalist and religious parties giving it a majority.

The poll by the Maagar Mochot agency surveyed 504 people and had a margin of error of 4.5 percent.
